Heterogenous flows across system boundaries continue to pose significant problems for efficient resource allocation especially with respect to long term strategic planning and immediate problems about allocation to address particular resource shortages. The approach taken here to modelling such flows is an engineering change prediction one. This enables margin modelling by producing system models in dependency matrices with different linkage types. Change prediction approaches from engineering design can analyse where these bottlenecks in integrated systems would be so that resources can (...) be deployed flexibility to avoid them and address them when they occur. Current state of the art of margin research can be furthered by identifying margins on multiple levels of system composition. It can usefully be complemented by a category theory based approach which allows representation of variable and constant properties of models under changing conditions, and the identification of flows within models. Category theory is useful for formalising such explanatory frameworks as it can both structure systems and permit analysis of their applications in a complementary way. (shrink)

As most engineering design proceeds by modifying past designs and reusing and adapting existing components and solution principles, a significant part of the knowledge engineers employ in design is encapsulated in the past designs they are familiar with. References to past designs, as well as encounters with them, serve to invoke the knowledge associated with them and constructed from them. This chapter argues that much of this knowledge is tacit consisting in and/or made available by the perceptual recognition of features (...) and situations, using a discussion of design margins to illustrate how engineers use tacit knowledge in reasoning about the properties of new designs. Since its discovery in 1912, X-ray crystallography has become a most useful tool in physics, chemistry, material science, mineralogy, metallurgy, and even in the biological sciences. In 1914, Max von Laue was awarded the Nobel Prize “for the discovery of X-ray diffraction by crystals,” followed by the 1915 Nobel Prize to William Henry Bragg and William Lawrence Bragg “for their services in analysis of crystal structure by means of X-rays.” And these early Nobel prizes marked only the beginning of X-ray (...) crystallography as one of the most fruitful methods in the history of modern science. This is an important book. Its author, Roslyn Weiss, contends that the Socratic Paradox, "No one does wrong willingly," and related Socratic views about the virtues have been seriously misinterpreted. Socrates is not the moral intellectualist, ethical/psychological egoist, and eudaimonist generations of scholars have believed him to be. The arguments in which Socrates articulates versions of the Socratic Paradox must be examined with respect to their overall agonistic contexts. The Socratic Paradox, when it appears, operates as a rhetorical weapon against (...) a specific class of interlocutor enemies—the Sophists.The significance of Weiss's thesis cannot be underestimated. If her view is correct, the delineation between early "Socratic" dialogues, marked by problematic Socratic doctrines like "No one does wrong willingly," and later "Platonic" dialogues, is significantly eroded. Perhaps other, thematic and/or methodological features mark distinctions between groups of dialogues, yet the overall effect of dispensing with this particular doctrine is spectacular. A saner Platonic Socrates emerges along with improved coherence across Plato's dialogues. Weiss builds her case in careful detail. (shrink)

In the post-genome world of biomedical research, an increasingly common research strategy is to focus on large repositories of biological specimens. There are now several well-known efforts to compile vast collections of biological materials, reanalyze extant samples, collect new ones, and link the samples to medical records. The significant issues of law, ethics, and policy raised by these research activities usually are heightened when commercial enterprises play a leading role in accumulating and distributing the samples. Emerging companies are not only (...) compiling repositories for their own use, but some companies are positioning themselves to act as intermediaries, developing vast biobanks for sale to a wide range of other researchers. Each year individuals are required to execute millions of authorizations for the release of their health records as a condition of employment, applying for various types of insurance, and submitting claims for benefits. Generally, there are no restrictions on the scope of information released pursuant to these compelled authorizations, and the development of a nationwide system of interoperable electronic health records will increase the amount of health information released. After quantifying the extent of these disclosures, this article discusses why it (...) is important to limit disclosures of health information for nonmedical purposes as well as how it may be possible to do so. How should we understand religion, and what place should it hold, in an age in which metaphysics has come into disrepute? The metaphysical assumptions which supported traditional theologies are no longer widely accepted, but it is not clear how this 'end of metaphysics' should be understood, nor what implications it ought to have for our understanding of religion. At the same time there is renewed interest in the sacred and the divine in disciplines as varied as philosophy, psychology, literature, history, (...) anthropology, and cultural studies. In this volume, leading philosophers in the United States and Europe address the decline of metaphysics and the space which this decline has opened for non-theological understandings of religion. DNA identification methods are such an established part of our law enforcement and criminal justice systems it is hard to believe that the technologies were developed as recently as the mid-1980s, and that the databases of law enforcement profiles were established in the 1990s. Although the first databases were limited to the DNA profiles of convicted rapists and murderers, the success of these databases in solving violent crimes provided the impetus for Congress and state legislatures to expand the scope of (...) the databases with little critical examination of each expansion's value to law enforcement or cost to privacy and civil liberties.We are now entering a new stage of DNA forensics, in which successive database expansions over the last decade have raised the possibility of creating a population-wide repository. In addition, new applications of DNA profiling, including familial and low stringency searches, have been added to DNA dragnets, the use of medical samples for forensic analysis, and other measures to create a series of crucial, yet largely unexplored, second-generation legal and policy issues. Calling for an expanded framework of EuroAmerican science's methodology whose perspective acknowledges both quantitative/etic and qualitative/emic orientations is the broad focus of this article. More specifically this article argues that our understanding of shamanic and/or other related states of consciousness has been greatly enhanced through ethnographic methods, yet in their present form these methods fail to provide the means to fully comprehend these states. They fail, or are limited, because this approach is only a “cognitive interpretation” or “metanarrative” of the (...) actual experience and not the experience itself. Consequently this perspective is also limited because the researcher continues to assess his or her data through the lens of their symbolic constructs, thereby preventing them from truly experiencing shamanic and psi/spirit approaches to knowing since the data collection process does not “in and of itself” affect the observer. We, therefore, need expanded ethnographic methods that include within their approaches an understanding of methods and techniques to experientially encounter these states of consciousness—and become transformed by them. Our becoming transformed and then recollecting our ethnoautobiographical experiences is the means toward a new kind of science and its methods of inquiry that this article seeks to encourage. The Rationality Principle says that people act adequately to their situation, but does not specify how they must act in order to do so. Situational Analysis uses the Rationality Principle, together with a model of the social situation, to explain actions in the past. Unlike Rational Choice Theory, Situational Analysis does not try to predict or influence actions in the future. Popper regarded the Rationality Principle as false, but thought that we should use it nonetheless. This poses a problem for (...) understanding his views about conjecture and refutation. Popper, however, thought that all scientific models are false, and that whether or not we should reject a model depends on the problem that we are trying to solve. (shrink)

The dynamical patterns in mental phenomena have a characteristic suppleness&emdash;a looseness or softness that persistently resists precise formulation&emdash;which apparently underlies the frame problem of artificial intelligence. This suppleness also undermines contemporary philosophical functionalist attempts to define mental capacities. Living systems display an analogous form of supple dynamics. However, the supple dynamics of living systems have been captured in recent artificial life models, due to the emergent architecture of those models. This suggests that analogous emergent models might be able to explain (...) supple dynamics of mental phenomena. These emergent models of the supple mind, if successful, would refashion the nature of contemporary functionalism in the philosophy of mind. (shrink)

For fifty years Hubert Dreyfus has done pioneering work which brings phenomenology and existentialism to bear on the philosophical and scientific study of the mind. This is a selection of his most influential essays, developing his critique of the representational model of the mind in analytical philosophy of mind and mainstream cognitive science.

There is a long history of cryptographic hash functions, i.e. functions mapping variable-length strings to fixed-length strings, and such functions are also expected to enjoy certain security properties. Hash functions can be effected via modular arithmetic, permutation-based schemes, chaotic mixing, and so on. Herein we introduce the notion of an artificial-life (ALife) hash function (ALHF), whereby the requisite mixing action of a good hash function is accomplished via ALife rules that give rise to complex evolution of a given system. The HIPAA Privacy Rule is notoriously weak because of its incomplete coverage, numerous exclusions and exemptions, and limited rights for individuals. The three areas in which it provides the most protection are fundraising, marketing, and research. Provisions of the 21st Century Cures Act, pending in Congress, and the Notice of Proposed Rulemaking to amend the federal research regulations, awaiting final regulatory action, would weaken the privacy protections for research. If these measures are adopted, the HIPAA Privacy Rule would have so (...) little value that it might not be worth the aggravation and burden. (shrink)

New developments in genetics could affect a variety of real property rights. Mortgage lenders, mortgage insurers, real estate sellers, senior living centers, retirement communities, or other parties in residential real estate transactions begin requiring predictive genetic information as part of the application process. One likely use would be by retirement communities to learn an individual's genetic risk for Alzheimer's disease. The federal Fair Housing Act prohibits discrimination based on disability, but it is not clear that it would apply to genetic (...) risk assessments. Only California law explicitly applies to this situation and there have been no reported cases. (shrink)

Abstract:Moral imagination is a reasoning process thought to counter the organizational factors that corrupt ethical judgment. We describe the psychology of moral imagination as composed of the four decision processes identified by Rest (1986), i.e., moral sensitivity, moral judgment, moral intention, and moral behavior. We examine each process in depth, distilling extant psychological research and indicating organizational implications. The conclusion offers suggestions for future research.The majority of men are subjective toward themselves and objective toward all others—terribly objective sometimes—but the real (...) task is in fact to be objective toward one’s self and subjective toward all others. Malevolence and cruelty are commonly attributed to a failure of moral reasoning or a lack of moral imagination. We present the contrasting viewpoint – immorality as an active, creative, or resourceful act. More specifically, we develop the concept of "immoral imagination" (Jacobs, 1991) and explore how it can enter into Rest's (1986) four processes of decision making: sensitivity, judgment, intention, and implementation. The literature on revenge and workplace deviance illustrates these processes.

Those interested in the relationship betw een environment structure and behavior — the topic of this special issue of Adaptive Behavior — w ill find much of value in Peter Godfrey-Smith's new book, Complexity and the Function of Mind in Nature (hereafter CFMN; all page citations are to CFMN unless otherw ise indicated). The w riting is clear and concise, aptly balancing precision and breadth, and a host of relevant issues are raised and advanced. Although my comments here w ill (...) focus only on the book's fundamental conceptual framew ork for how organisms relate to their environments, I enthusiastically recommend the entire book. In an earlier paper my colleagues and I put forth a theory called “perceiving-the-present” that predicts a systematic pattern across a large variety of illusions, and we presented evidence that the systematic pattern exists. Briscoe puts forth arguments against the theory and the existence of the systematic pattern. Here I provide counterarguments to his criticisms of the theory, and I explain why his arguments do not bear on the existence of the systematic pattern.

This paper affirms the thesis that Kierkegaard can be properly and profitably read in light of the virtue tradition, broadly construed. I consider several objections to this thesis, including the idea that Kierkegaard largely opposes the culture of antiquity out of which the virtue tradition comes, that Kierkegaard’s emphasis on duty and the commanded nature of love is incompatible with genuine concerns of virtue ethics, and that Kierkegaard’s concept of faith is incompatible with a strong concern for the virtues. Then (...) I offer two avenues for broadening our thinking about his ethical philosophy in light of the attention he pays to the virtues. First, I argue that we may beneficially read Kierkegaard alongside Jane Austen, as someone whose writings reflect both the Christian and Aristotelian traditions. Second, in terms of contemporary moral philosophy, I suggest that Kierkegaard be placed in conversation with “radical virtue ethics,” a category recently introduced by David Solomon. (shrink)

It has been pending in Congress for twelve years, despite the support of the last two presidential Administrations and the National Institutes of Health. It has been the subject of extensive affirmative lobbying by academic medical centers, pharmaceutical and biotech companies, genetic disease advocacy groups, and civil rights organizations. It has overcome vehement objections by employers and insurers. Its final passage, however, has been thwarted by a few Congressional leaders, who have prevented enactment despite overwhelming bipartisan support in both houses (...) of Congress.Based on this legislative history, one could not help but assume that the Genetic Information Nondiscrimination Act is a revolutionary piece of legislation that, if finally enacted, would provide extensive, effective, and comprehensive protection against genetic discrimination in health insurance and employment Unfortunately, such an assessment would be incorrect. Stephens and Feezell argue, in?The Ideal of the Stoic Sportsman?, that?one need not be a scholar of ancient Greek philosophy to refer to?stoic? conduct or a?stoic? approach to certain matters, because the vocabulary related to this apparently antiquarian view of life has seeped into our common language?. Nonetheless, Stephens and Feezell go on to give a scholarly account of Stoicism as it relates to athletic participation. Their account, in part, takes the form of a distinction between?simple Stoicism? and?sophisticated Stoicism?? the (...) former being a common, contemporary grasp of Stoic moral psychology; the latter being a more sophisticated and historically accurate grasp of Stoic moral psychology. In fleshing out their more sophisticated account, they disclose a paradox. Given the Stoic sufficiency thesis? i.e., that the sole good is virtue? the Stoic sportsman must be indifferent to failure or winning. Yet the Stoic sportsman must be sufficiently attached to the athletic experience to use it as a means of developing virtuous states of character. That they dub the paradox the?paradox of Stoic detachment?.?Curiosity? Paradox? Or psychological incoherence?? they ask. The aim of the present undertaking is a?soft? critique of Stephens and Feezell? soft, because the critique is not so much a critical rejection of the authors' view tout court. Instead, I aim to point out deficiencies with their account and expand on other points not fully elucidated in it. The most salient point I make is that what they deem paradoxical is not really paradoxical, once there is a more thorough account and clearer grasp of Stoic?detachment? (shrink)

Normal systems of modal logic, interpreted as deontic logics, are unsuitable for a logic of conflicting obligations. By using modal operators based on a more complex semantics, however, we can provide for conflicting obligations, as in [9], which is formally similar to a fragment of the logic of ability later given in [2], Having gone that far, we may find it desirable to be able to express and consider claims about the comparative strengths, or degrees of urgency, of the conflicting (...) obligations under which we stand.
